Welcome to "Lek" by Blank Canvas Designs Private Limited. These Terms of Service govern your use of our app and any related services. By using "Lek," you agree to these terms. If you do not agree with any part of these terms, please do not use the app.

1. General Information

"Lek" is an iOS application designed to help users generate LinkedIn posts using AI, based on text or voice input. By using the app, you agree to abide by these Terms of Service and our Privacy Policy.

2. Eligibility

By using "Lek," you confirm that you are at least 18 years old and legally capable of entering into a contract. You are responsible for ensuring that all information you provide is accurate and up-to-date.

3. Subscriptions

• Subscription Activation: Your subscription will be activated upon payment confirmation via the App Store.
• Billing Cycle: Subscriptions are billed automatically on a recurring basis according to the billing cycle you select (monthly, yearly, etc.).
• Payment: All subscription payments are processed through the App Store and are subject to Apple’s terms and conditions.
• Cancellation: You may cancel your subscription at any time through your App Store account. If canceled, your access to premium features will continue until the end of the current billing cycle, after which the subscription will not renew.
• Refunds: All payments and refunds are handled in accordance with the App Store's refund policy. We do not handle payments or issue refunds directly.

4. User Responsibilities

• Account Security: You are responsible for maintaining the security of your device and any data generated through "Lek." We recommend using strong passwords and enabling device security features.
• Lawful Use: You agree not to use "Lek" for any unlawful activities or in violation of any applicable laws. You must also respect the rights of others and refrain from posting or generating offensive, defamatory, or infringing content.
• Data: You acknowledge that any data input into "Lek" (via text or voice) will be transmitted to OpenAI to generate content. This data is not stored by us but is processed solely for the purpose of creating LinkedIn posts.

5. Data Processing and GDPR Compliance

In compliance with the General Data Protection Regulation (GDPR) and other international data privacy laws, we are committed to protecting your data. When you use "Lek," certain personal data (e.g., text or voice transcriptions) may be transmitted to OpenAI for AI-based content generation.

• Data Control: Blank Canvas Designs Private Limited acts as the data controller, while OpenAI acts as a data processor.
• Purpose: The data transmitted to OpenAI is processed solely to generate LinkedIn posts based on your input.
• Data Retention: We do not retain or store any personal data once the AI process is complete, and all data remains on your device after generation.
• User Rights (GDPR): Under GDPR, you have the right to:
  • Access your data
  • Correct inaccurate data
  • Request deletion of your data (you can do this by deleting the app, which removes all data from your device)
  • Restrict processing or object to processing
  • Portability: As all data is stored locally on your device, you have full control over your data and can manage its portability.

6. International Data Transfers

When you use "Lek," data may be transmitted to OpenAI, which may involve international data transfers outside of your country of residence. OpenAI has implemented security measures to protect your data, but by using "Lek," you consent to this data transfer.

We ensure that such transfers are in line with GDPR and other applicable data protection laws, ensuring that adequate protections are in place to safeguard your information.

Data provided to OpenAI is subject to OpenAI’s privacy policy. OpenAI processes your data only to provide the requested AI-generated content. We encourage you to review OpenAI’s privacy policy for more information on their data practices.

8. Children's Privacy

Our app is not intended for children under 13 years of age. We do not knowingly collect or store data from individuals under 13, and if we become aware that such data has been provided, it will be promptly deleted.

9. Security

While we ensure that the app follows best practices for security within the iOS environment, we recommend users take standard precautions to protect their device, such as using strong passwords and enabling device security features.

10. Termination

We reserve the right to suspend or terminate your access to "Lek" at any time, without notice, for any violation of these Terms of Service. In such cases, we may cancel your subscription, and no refunds will be issued.

If you choose to delete "Lek" from your device, all associated data will be permanently deleted as well. There is no way to recover the data once it is deleted from your device.

11. Disclaimer of Warranties

"Lek" is provided on an "as is" basis without any warranties of any kind. We make no guarantees that the app will be error-free or uninterrupted, or that it will meet your specific requirements.

• Data Accuracy: While we strive to provide accurate and high-quality content generation, we cannot guarantee the accuracy or appropriateness of the AI-generated posts.
• Service Availability: We aim to provide 99% uptime but cannot guarantee uninterrupted access due to maintenance, updates, or unforeseen issues.

12. Limitation of Liability

To the maximum extent permitted by law, Blank Canvas Designs Private Limited will not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of "Lek." This includes, but is not limited to, any loss of data, loss of profits, or interruptions in service.

13. Modifications

We reserve the right to update or modify these Terms of Service at any time. Any changes will be posted within the app, and continued use of "Lek" after such changes constitutes acceptance of the updated terms.

14. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of Maharashtra, India. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts located in Pune, India.

For users in the European Union (EU) or other regions with specific privacy laws, by using "Lek," you consent to the transfer of your personal data to India and OpenAI’s servers, acknowledging that these jurisdictions may not provide the same level of data protection as your home country.
